Terms and Conditions

General terms and conditions Fenix Food Factory


1. These terms and conditions apply to every offer, hereinafter referred to as the Agreement, which has been concluded between Fenix Food Factory BV, hereinafter referred to as Service Provider, and the user referred to by name in this Agreement, hereinafter referred to as Guest. All offers from the Service Provider are without obligation, unless a term for acceptance has been set in the offer. If no acceptance period has been set, no rights can be derived from the quotation if the product to which the quotation relates is no longer available in the meantime. These General Terms and Conditions form an integral part of the Agreement.


2. The Guest is responsible for complying with the statutory regulations and house rules with regard to what has been agreed in the Agreement. If requested, the Service Provider will provide information about house rules arising from necessary permits, etc


3. For the purpose of police and fire regulations, the Guest is bound by the maximum room capacity promised by the Service Provider. Instructions from the Service Provider's staff with regard to safety must be followed by the Guest at all times. Guest's staff is entitled to refuse access to the space for an excess of the public.


4. Beverages from external suppliers supplied by the Guest are not permitted within the Service Provider's space without the permission of the Service Provider.

5. It is not allowed to consume your own consumptions unless otherwise agreed with the Service Provider. In addition, the Service Provider is also entitled to refrain from providing catering services or to discontinue them at any time if the guest does not behave in accordance with the position, operation and house rules of the Service Provider. The Service Provider is entitled to discontinue the provision of products if, in the opinion of the employee or entrepreneur, there is excessive drinking or undesirable behaviour.

6. If the Guest consumes drinks in the Service Provider's space that have not been provided by the Service Provider, the Guest will owe an amount of EUR 15.00 (excl. VAT) in corkage for each bottle consumed. If the Guest consumes food in the Service Provider's space that has not been provided by the Service Provider, the Guest will owe an amount in corkage.

7. With more than 20% of dietary requirements, the Service Provider is forced to submit a new price to the Guest.


8. The Guest is liable for all damage caused by him and persons admitted by him to the space of the Service Provider and/or inventory and/or theft of property of the Service Provider.

9. The Service Provider is not liable for damage to property of the Guest or persons or institutions admitted by the Guest. The Service Provider is at all times only liable for damage against which the Service Provider is insured or should reasonably have been insured and for the maximum amount covered by that insurance.

10. A claim for damages cannot be rejected on the grounds of lack of accountability. If the Guest does not repair the space or inventory of the Service Provider, after the request thereto by the Service Provider, this will lead to an obligation to pay compensation for the damage to the space or property of the Service Provider.


11. Parking is paid at Katendrecht. In parking garageQpark(Veerlaan) paid parking is available 24/7 from Monday to Sunday.



12. Upon confirmation of the quotation >500 euros excl. VAT by the Guest, the Guest must make a down payment of 45% of the quotation amount.

13. The remaining amount (invoice amount minus down payments) must be paid within 14 days after the invoice date to account number: NL44 RABO 0347 4198 95 attn. Fenix Food Factory BV stating the invoice number, unless agreed otherwise in writing.

14. The Guest will receive an invoice after the service has been provided by the Service Provider. Payment must be made within 14 days of the invoice date. After this, the Service Provider is entitled to charge the statutory interest.



15. The prices stated in the quotation are exclusive of VAT, unless stated otherwise.



16. A change in the number of people or in the program may entail a change in price. Up to one week before the start of the event, you can adjust the number of people free of charge with a margin of 10%. If this deviation is greater than 10%, the price of the restorative care will be increased by a proportional percentage.


17. Up to four weeks before the date on which the service takes place, the Guest does not owe any amount in the event of cancellation as compensation for costs incurred and loss of income. After this, if canceled up to three weeks, two weeks, one week and less than one week before the date of the service, the Guest owes the Service Provider 25%, 50%, 75% and 100% respectively of the above costs.



18. It is prohibited to smoke and/or use/possess drugs in the Service Provider's space.

19. The Agreement concluded between the Service Provider and the Guest is governed exclusively by Dutch law. Disputes arising from this Agreement will also be settled under Dutch law by the competent court in Rotterdam.

20. The Service Provider reserves the right to change prices and product compositions.

21. These Conditions may be changed in the interim.
